1. Acceptance of Terms

By accessing or using Relaxo (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We may update these terms from time to time, and your continued use constitutes acceptance of any changes.

2. Description of Service

Relaxo provides a platform for vacation rental hosts to create and manage digital guidebooks for their properties. Guests can access these guidebooks via unique URLs without creating an account. The Service includes features for property management, guest communication, and analytics.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Post illegal, harmful, threatening, abusive, or objectionable content
  • Infringe on intellectual property rights of others
  • Distribute spam, malware, or other malicious content
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Use the Service for any fraudulent or deceptive purpose

5. User Content

You retain ownership of all content you create or upload to the Service ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of providing the Service.

You are solely responsible for your User Content and represent that you have all necessary rights to post it. We do not endorse or guarantee the accuracy of any User Content.

6. Payment and Billing

Certain features of the Service require a paid subscription. By subscribing, you agree to:

  • Pay all applicable fees as described at the time of purchase
  • Provide valid payment information through our payment processor (Stripe)
  • Authorize recurring charges for subscription plans

Subscription fees are billed in advance on a monthly or annual basis. Refunds may be provided at our discretion. You may cancel your subscription at any time, and you will retain access until the end of your current billing period.

7. Intellectual Property

The Service, including its original content (excluding User Content), features, and functionality, is owned by Relaxo and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

8. Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Breach of these Terms of Service
  • Fraudulent, illegal, or harmful activity
  • Non-payment of fees
  • Any reason at our sole discretion

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease, and we may delete your data in accordance with our Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RELAXO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Relaxo and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance.
